These Terms of Service ("Terms") govern your access to and use of the Berlink website (berlinkoriginal.com) and all products and services offered by Berlink ("we," "us," or "our"). By accessing or using our website and purchasing our products, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our website or purchase our products.

1. Acceptance of Terms

We reserve the right to refuse service to anyone for any reason at any time. Credit card information is always encrypted during transfer over networks.

Our watches are described as accurately as possible on the website. However, we cannot guarantee that your computer monitor's display of any color will be accurate. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time.

While we strive for accuracy, the images of our watches on our website are for illustrative purposes only. Your watch may vary slightly from those images.

We reserve the right, but are not obligated, to limit the sales of our products or services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer.

 

4. Pricing and Payment

All prices on the Berlink website are primarily displayed in Malaysian Ringgit (MYR). For the convenience of our international customers, prices may also be displayed in Hong Kong Dollars (HKD) and United States Dollars (USD) based on your detected location or selected currency preference.

  • Pricing Basis: All product prices are set in MYR as our base currency. Prices displayed in HKD and USD are converted from MYR using current exchange rates provided by our payment processor (Shopify Payments). These exchange rates are updated regularly.

  • Final Transaction Currency: The final transaction currency will be based on the currency you select or that is determined by the Shopify checkout process. You will see the final amount in the selected currency before completing your purchase.

  • Currency Conversion Fluctuation: Due to the fluctuating nature of exchange rates, the exact amount charged in HKD or USD may vary slightly from the displayed price at the moment of Browse, depending on the real-time exchange rate applied at the time of transaction processing.

  • Additional Charges: Prices exclude shipping costs unless explicitly mentioned (e.g., free shipping offers). Applicable taxes, customs duties, and import fees will be added at checkout where required by law or as detailed in our Shipping Policy.

  • Price Changes: We reserve the right to change prices for our products at any time without prior notice.

  • Payment Methods: We accept various payment methods as indicated at checkout. By providing payment information, you represent and warrant that you are authorized to use the designated payment method and authorize us to charge your order (including any shipping fees and applicable taxes) to that payment method.

 

5. Order Acceptance and Cancellation

Your order constitutes an offer to us to buy a product. All orders are subject to acceptance by us, and we will confirm such acceptance to you by sending you an email that confirms that the product has been shipped (the "Shipping Confirmation"). The contract between us ("Contract") will only be formed when we send you the Shipping Confirmation.

We reserve the right to refuse or cancel any order for any reason, including limitations on quantities available for purchase, inaccuracies, or errors in product or pricing information, or problems identified by our fraud prevention department. If we cancel an order after you have been charged, we will issue a full refund.

8. Warranty (Optional but Recommended for Watches)

Berlink watches come with a 5-year limited warranty from the date of purchase, covering manufacturing defects in the watch movement, hands, and dial. This warranty does not cover:

  • Battery, case, crystal, strap, or bracelet.

  • Damage resulting from improper handling, lack of care, accidents, or normal wear and tear.

  • Water damage unless the watch is marked as water-resistant to a specific depth and the damage occurred within those specifications (e.g., submersion beyond rated depth).

  • Damage caused by unauthorized repair or modification.

To make a warranty claim, please contact our support email at berlinkoriginal@gmail.com. You may be required to return the watch for inspection. Shipping costs for warranty claims may be the responsibility of the customer, or covered by Berlink at our discretion.

 

9. Intellectual Property

All content on this site, including but not limited to text, graphics, logos, images, audio clips, video clips, data compilations, and software, is the property of Berlink or its content suppliers and protected by international copyright laws. The compilation of all content on this site is the exclusive property of Berlink and protected by international copyright laws.

The Berlink name, logo, and all related names, designs, and slogans are trademarks of Geneve Corporation Sdn Bhd or its affiliates or licensors. You must not use such marks without our prior written permission.

 

10. User Conduct

You agree not to use the website for any unlawful purpose or any purpose prohibited by these Terms. You may not use the website in any manner that could damage, disable, overburden, or impair the website or interfere with any other party's use and enjoyment of the website.

You are prohibited from posting or transmitting to or from this website any unlawful, threatening, libelous, defamatory, obscene, inflammatory, pornographic, or profane material, or any other material that could give rise to any civil or criminal liability under the law.

 

11. Disclaimer of Warranties; Limitation of Liability

We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free. We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable.

In no case shall Berlink, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility.

Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

13. Severability

 that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

 

14. Termination

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).
